Terms and Conditions
1 Service Description
Confirmalia is an event-management service operated by CHAMBITA LAB S.A.P.I de C.V., located at Calle Doctor José Luna Ayala Número 120, Colonia San Jerónimo, Monterrey, Nuevo León, C.P. 64640, Mexico. Users ("Organizers") can manage guests, invitations, attendance confirmations (RSVPs), questions, reminders, notices, guest portals, QR check-in and, when enabled, digital albums. Communications use WhatsApp and other channels available in the product, such as SMS when selected by the Organizer. Availability and charges depend on the feature and purchase shown in the Service.
2 User Accounts
To create an account, you must have legal capacity to contract and provide accurate information. If you act for an organization or client, you must have authority to do so and to manage the event and its data. By registering after having access to these Terms, you agree to them. You are responsible for protecting your credentials and managing access granted to your team or collaborators. Notify us promptly of unauthorized use. This does not remove Confirmalia's own security obligations.
3 Plans, Payments, and Billing
- You can create and prepare events free of charge. Paid features use prepaid credits or the purchase expressly shown before payment. The current credit offer consists of one-time purchases, with no monthly subscription or automatic renewal. Credits belong to the account and have no expiration date while the account remains available under these Terms.
- Payments: purchases are processed through the payment provider or app store indicated at checkout. The quantity, total price, currency, applicable taxes and payment method are shown before you confirm the transaction. Keep your payment receipt and contact us if a charge or credit allocation is incorrect.
- Credit Usage: invitations, notices, additional reminders, SMS and optional features may have different credit costs. Consult the amount shown before authorizing each action. Credits pay for the requested processing or feature under the conditions shown; a queued or sent message does not necessarily mean it was delivered or read.
- Payment Failures: a declined or unconfirmed payment does not complete a purchase. Any correction for an erroneous charge, refund or payment reversal must take account of the affected transaction and credits, without removing rights provided by law.
- Prices and Taxes: the currency and total applicable to your purchase are those shown at checkout; prices may vary by country, channel or app store. Changes to future offers do not retroactively change a completed purchase or remove rights already acquired.
4 Cancellation and Refund Policy
- Cancellation: you may stop using the Service and request account closure at the contact email below. Export the information you need before requesting deletion. Closing an account ends access to its events and credit balance and does not by itself create a refund entitlement. Requests to erase personal data will be handled under the Privacy Notice, including any applicable legal retention duties.
- Refund: for new credit purchases, we do not offer voluntary refunds for a change of mind, event cancellation or unused credits. We will address duplicate or erroneous charges, failures attributable to Confirmalia, and refunds, remedies or compensation required by applicable law. Write to the contact email with the transaction reference and a description of the issue, without sending full card details. App-store purchases also follow the store's applicable procedures. Any refund guarantee expressly offered when you purchased remains applicable under its original conditions, including the seven-day guarantee for a first subscription payment where that offer applied.
5 User Content and Acceptable Use
You retain the rights you hold in the material you upload ("User Content") and must have the permissions needed to use it. Personal data remains subject to the rights of each data subject. You authorize Confirmalia to host, reproduce, adapt formats and transmit that material only as needed to provide the requested features, through the necessary service providers, and for the applicable service and retention periods. This authorization does not transfer ownership or authorize unrelated advertising use.
- You must lawfully obtain guest data, provide the required privacy information and obtain the permissions required for the selected communication channel. Knowing someone's telephone number does not, by itself, establish permission to send messages. You must honor requests to stop communications, remove the recipient from future sends and notify us if assistance is needed.
- You must not use the Service to send spam, unsolicited messages, or content that is illegal, fraudulent, harassing, defamatory, or infringes third-party rights.
- You must not upload purchased contact lists or lists obtained without the individuals' consent.
- You must comply with the messaging provider's policies, telecommunications carrier requirements, and the privacy and communications laws applicable in the recipient's country.
Collect only information needed for your event. Do not request identity documents, full payment credentials or unnecessary sensitive data. Questions about allergies, health or other sensitive matters require the notices and express consent required by applicable law. The Organizer must review automated classifications and responses before relying on them, especially for catering, accessibility or attendee safety; these features do not provide medical advice or guarantee the absence of errors.
The Organizer is responsible for checking recipient numbers, event information, recipients, content and scheduling before authorizing an action, and for keeping evidence of the permissions it must obtain. The Organizer must cooperate in resolving claims arising from its content, instructions or lack of authorization and bear the liability legally attributable to those acts. This does not include liability for acts attributable to Confirmalia.
Keep personal guest links, QR passes and shared reports accessible only to their intended recipients. A person holding a link may be able to view information or perform actions associated with it. If you enable the album, obtain the permissions needed to upload and share photographs, including those concerning minors. Check its displayed closing date and download the photographs before it expires; Confirmalia is not a permanent archive.
We may restrict or suspend use for a breach of these Terms, fraud, a security risk or a valid legal requirement. The measure must be proportionate to the reason. We will communicate the reason and a means to seek review when legally and operationally possible; an urgent risk may require immediate restriction. Suspension does not remove rights acquired through a purchase or remedies required by law.
6 Data Privacy
We respect your privacy and that of your guests. Our use of personal data is governed by our Privacy Notice. CHAMBITA LAB S.A.P.I de C.V., located at Calle Doctor José Luna Ayala Número 120, Interior C3, Colonia San Jerónimo, Monterrey, Nuevo León, C.P. 64640, is the data controller under Mexico's Federal Law on the Protection of Personal Data Held by Private Parties.
For guest data processed on the Organizer's behalf, the Organizer determines the event purposes and instructs Confirmalia through the selected features and settings. Confirmalia's obligations include limiting processing to the authorized service or legal requirements, maintaining confidentiality and appropriate security measures, and assisting with data-subject requests. Necessary providers may participate in providing the Service under the Privacy Notice. Any additional data-processing or international-transfer requirements applicable to a particular relationship must also be respected.
7 Intellectual Property
The software, the "Confirmalia" trademark, logo, design, interfaces, and all content related to the Service are the exclusive property of CHAMBITA LAB S.A.P.I de C.V. or its licensors.
The user is granted a limited, non-exclusive, non-transferable, and revocable license to use the Service solely under the terms set forth herein. The user does not acquire any intellectual property rights through use of the Service.
8 Limitation of Liability
Confirmalia provides a technology tool and does not organize, supervise or guarantee the outcome of the event. The Organizer is responsible for its event, contracts with vendors and decisions based on guest information. We do not guarantee uninterrupted availability, an exact delivery time, attendance or the accuracy of every automated interpretation. To the extent permitted by law, Confirmalia is not liable for consequences caused by incorrect data or unauthorized content supplied by the Organizer, its handling of access links, guest decisions, or third-party interruptions outside Confirmalia's reasonable control, provided those consequences are not attributable to a breach by Confirmalia. Mandatory liability and rights to refunds or compensation remain applicable.
9 Use of WhatsApp
WhatsApp communications depend on Meta's availability, approved templates, messaging policies and recipient settings. SMS also depends on the messaging provider, carrier and supported destination. These providers may reject, delay or restrict messages. Queued, sent, delivered and read are different states. A recipient's failure to respond or attend is not, by itself, a failure of the Service. These dependencies do not excuse a failure attributable to Confirmalia or remove rights provided by law.
10 Changes to the Terms
We may update these Terms for future use and purchases. We will publish the updated version and provide advance notice of material changes through the Service or by email, obtaining acceptance when required. An update does not retroactively remove conditions, guarantees or rights acquired through an earlier purchase. If you disagree with a change, you may stop using the Service and request closure without losing rights granted by law.
11 Governing Law and Jurisdiction
These Terms are governed by the applicable laws of Mexico. Subject to mandatory jurisdiction rules, disputes may be submitted to the competent courts of Monterrey, Nuevo León, México. This does not prevent you from contacting consumer or data-protection authorities, or exercising rights and jurisdiction protections that mandatorily apply in your location.
